  4. Hi, I am just throwing an idea around about flyers that we could pass out at events, leave on car windshields or house doorsteps. Just thought it would be great if MFJ website could come up with a downloadable flyer about Barry’s case and the change.org petition so people can print one off and make their own copies to hand out. I don’t know if that is helpful or do able, but just wanted to throw that idea out there. Anything to get his name and the petition out there. I would be very willing to take to the streets leaving flyers all around. Not enough people know his name or struggle. Thanks and God bless everyone fighting for Barry!

      This is a great idea. We are still trying to get all the information together to finish this website, which I believe will be very soon. We will be sure to include a downloadable flyer you can print out in color or black & white. Thanks for the feedback and thanks for your support.

      A few weeks ago, I created a handout to give to friends and people I spoke with about this case. I tried to compile the main reasons that people seemed to be signing the petition. Since I don’t have the opportunity to attach a file to a post, I’m copying the content from the handout below. I realize it isn’t perfect, and I was really working to keep it to a single page. But if this content helps you in creating something for yourself, by all means, take what you feel is helpful.

      Reasons to Petition Governor Bullock to Pardon Barry Beach

      Montanans for Justice is working to gather 10,000 signatures on a petition to have Governor Bullock pardon Barry Beach. The direct link to the petition is at:

      Reasons to consider in signing the petition:
      • You know / believe Barry beach is innocent of the crime he was convicted of in1984. Perhaps you are from the area or know people involved or have investigated this case on your own.
      • You believe the confession was coerced or is very likely to have been coerced. Without any forensic evidence, witness testimony, or corroboration tying Beach to the crime, it is likely that he didn’t do it.
      • Too many people have come forward since the conviction in 1984 that it casts serious doubt that the right person or people were convicted for this crime.
      • The law enforcement agencies and the Montana state crime lab have lost / destroyed important DNA evidence in this case which could exonerate Beach.
      • For someone who was 17-years-old at the time of the crime, it is cruel and unusual punishment to sentence Beach to 100 years with no opportunity for parole.
      • You don’t know if he did it or not, but even if he did, he has served 29 years already, which is more than twice the average amount of time served for this type of crime.
      • For almost 18 months from December 2011 to mid-May 2013, Beach was a tax-paying, productive citizen in Billings and was rehabilitated (even if he did do it). Why should we be paying $31,000 per year to incarcerate him when there are so many questions / uncertainties about this case?
      • The Supreme Court seemed to over-step its role in deeming all new witnesses and evidence at the August 2011 evidentiary hearing to be non-credible – even though District Judge E. Wayne Phillips determined that if the original jury had heard the additional testimony, they likely would not have convicted Beach. Judge Phillips was in the best position to determine credibility to order a retrial.
      • You feel that it is a jury’s responsibility to weigh all of the evidence and to determine the credibility of ALL evidence, including the confession and new testimony.
      • You feel that politics is a considerable concern with this case since the prosecuting attorney (Marc Racicot) went on to become Governor of Montana from 1993 – 2001. You find the Supreme Court ruling suspicious in that the four justices who ruled to overturn Judge Phillips all have strong ties to Racicot, including serving under him earlier in their careers or being appointed to various positions by him.

        If we could please mention one thing: We created the change.org petition for two reasons. First, we did not have our new site built yet and second, we wanted to utilize the tools they offer to reach people we would not normally reach. Otherwise, we would like to use the petition on this site as the primary petition and keep people coming to the MFJ website. If you could please help us in the future to make better use of this website (and promote it), we would be appreciative.

        • Of course. I’m pretty sure that I put together that flier early on while you were still rolling out the new website (or at about the same time). So what I posted above was just copied from what I have.

          I think it was only in the last 10 days that I realized that the petition on the new MFJ website seems to be a different petition. I’d actually meant to ask about that, so thanks for clarifying.

    This has never been a matter of persuading the state to “open their minds”, or working to get them to “see the truth”, as that would imply that they only made some oversights, or errors in their judgment. They know the truth, which is the very reason why they won’t allow it to come out, as it would expose the very existence of the corruption within the system of which many played a part in. In their minds, it’s a mentality based upon, ‘Hurt many?’ Or hurt ‘just one?’

    So pretty much, by not stopping the corruption where it started, with ‘just one’ person, it was instead, supported, allowing it to in fact grow larger, gaining more followers along the way, as many were, (and still are) too afraid NOT to follow.

    Even most of those within the system who DO believe in Barry’s innocence may never say so, simply due to fear of backlash or retaliation of some kind. I say ‘most’ because as we have seen, the ones who do allow for the truth to be found, while doing so under the proper guidelines, (AT the request of the Supreme Court), are quickly discredited as to making an ‘error’ in judgment., (BY the Supreme Court). This also means they, (of the SC) are either too incompetent to follow their own guidelines, or too arrogant to think they have to.

    This is the kind of corruption that the system is supposed to protect the people from, NOT expose them to. THIS is the kind of corruption and deception that goes back so far and so deep, that if it were to become untangled, it would expose the biggest and most crooked scheme this state has ever seen. And it all started with ‘just one’ person.

    So which ‘one’ should have to pay the ultimate price for this? The one of ‘corruption’, or the one of ‘innocence’?

    The sooner this case is taken out of the state of Montana, the sooner it will see a real chance at justice, as it will gain even more exposure and pubic awareness. It’s just a matter of formalities and following the appropriate steps in getting there. But that day WILL come, and what a day it will be!

    And the one(s) of corruption will only HOPE that God will have mercy on their sad and sorry souls… in the way they did NOT with Barry Beach!

    Please free BARRY BEACH. I do believe he is innocent, however only he and God know for sure. BARRY has been a productive citizen for the past 18 months and was doing very well. He has been a great asset to society. He has served almost 30 years already, which is more then most guilty people serve. Where is justice?

    How can they live with themselves in Poplar knowing what they have done? First to Kim and then to Barry? Maybe that is why they have never amounted to anything. Like Sissy said, “it’s karma!” and they haven’t seen anything YET!!!

    I am just stunned that the state of Montana has allowed this case against Barry to continue! Maude says she kicked Kim in the head, the FBI says they find nothing to connect Barry to the crime, Maude’s father contaminated evidence, there is NOTHING to connect Barry to Kim’s death except a coerced confession the has mysteriously disappeared! What does it take to prove that the wrong person is behind bars??!! I just don’t understand the reason this man is still locked up!! Montana should be ashamed!!

    EVERYONE in Poplar knows that Steve Greyhawk was the cop down at the river that night. Anyone test him for that palm print? Wasn’t he covering up for his daughter Maude

    Am glad this case will go to a higher court! Can’t wait until Joann, Maude, Sissy, Steve Grey Hawk, Caleb, Donny Jackson , eddy VanDover are all hauled in by the Feds! I wonder how they’re sleeping now????

    Those folks up in Poplar might be celebrating at the recent decision by the Supreme Court, however if this goes Federal, now they ALL will go down! Your dirty little secrets and years of lies, and covering up will all be exposed not just for Montanans but the entire United States. What a bitter sweet ending that will be.

    If Maude said she only kicked Kim in the head, then why would her dad, Steve Grayhawk go through so much trouble to break in to the evidence room? Maude has been involved now in two murders. Don’t forget she was involved in her husband, Dana Kirn’s, death as well!!!

  16. Motion For Reconsideration Timeframe

    There seems to have been quite a bit of discussion about when the Supreme Court will make a decision on the petition for reconsideration. It is not often that we choose to interject in discussion, but it is the understanding of MFJ that the Attorney General’s office has a specific timeframe to reply to Barry’s petition, which we believe is June 13th. After that, the Supreme Court may make a decision at any time. Considering that two of the judges that must weigh in on this matter do not sit on the Supreme Court, they will need to be called in and this could take some time. MFJ feels a sense of urgency in getting ALL public opinion to our elected officials as quickly as possible, but we do not believe there is a deadline in place at this time. We hope this helps and please, continue to write, call or visit our elected officials.

You all are real heroes for your continued service to not only Barry and his family, but to seeing justice prevail in Montana. In the face of such complete injustice, your conviction to this cause is truly inspiring and is what still allows me to be proud to be a Montanan.

    This is the most outrageous case I have ever seen! EVERYONE in Poplar knows who the killers are. When is the state going to step up and test some of those prints? Ooops, sorry, they’re scared of the truth! Barry deserves a new trial to not only clear his name, but to show the world he is an innocent man!

    I hope this case goes Federal and that those who killed Kim and those who were down at the river that night and stood by and watched and did nothing to help Kim and have done everything to cover this up and protect those who are guilty, spend the last of their every breathing days in a federal prison. THEN justice will be served!
